The use of services from nethideaway.com, nethideaway.net and nethideaway.org, [hereafter referred to as "The Hideaway"] constitutes agreement to these terms. If you do not agree with these terms or if these terms and conditions are not acceptable in full, you must immediately terminate your use of this site.
If you find something you consider to be a breach of these rules please email the Hermits at [abuse at nethideaway dot com] and include the URL where the breach occurred. If you can't figure out how to look at the chat archives to get the correct URL please provide the date, time and name of the chat room.
1. We reserve the right to refuse service to anyone. We'll probably never have to exercise the right to refuse service unless you become a thorn in our side. Don't do anything stupid.
2. TOS discussion is welcome at the Hideaway but individual abuse issues will not be dealt with on the Hideaway website or forums. Individual TOS abuse issues will be handled via email [abuse at nethideaway dot com].
3. The Hideaway reserves the right to require changes or disable as necessary
any membership, account, or any component that does not comply
with our established policies, or to make any such modifications/deletions in an
emergency at our sole discretion.
Description of Service
The Hideaway provides users and members with access to a broad collection of interactive online community services. This includes, but is not limited to, chat rooms, discussion forums, and other web publishing tools.
The Hideaway is intended for personal use by individuals. Any unauthorized commercial use of the Hideaway or resale, re purposing, or reproduction of the Hideaway's services is expressly prohibited. The Hideaway is not a commercial hosting service.
It is prohibited to use our services in connection with any junk email, spam email, or unsolicited email, commercial or otherwise.
It is prohibited to post real time information.
It is prohibited to "flood" any forum, guest book, chat room or any other publishing area at the Hideaway.
It is prohibited to transmit, post, or place on any pages of the Hideaway any virus, Trojan, worm, or any other harmful or deleterious code.
It is prohibited to post or incorporate any code which causes a browser to be redirected to another site, resized, spawn multiple windows, spawn multiple pop-ups, or otherwise affect the proper functioning of any browser or computer system.
Should your member areas attract excessive levels of traffic, or should you have any advertising in your member areas the Hideaway may, at our sole discretion, place advertising banners in your member areas.
All content is the sole responsibility of the submitter. The Hideaway has no obligation to monitor the service or any user's use thereof or retain the content of any user session.
If you find something within the Hideaway that you consider offensive, contact the person responsible for posting the material and bring it up with them. Please do not contact the Hermits, as we have no responsibility over the vast majority of our site's content. The Hideaway is merely a conduit for the existence of an online community with persons like yourself that are responsible for its content.
This is a community site. The Hermits are only here to provide you with a place to interact with each other in a shared environment, and to make sure the site is physically running smoothly. We are not your parents, police, or your baby sitters. If something in the physical place is amiss we will fix it, in due time :). However, if a particular member of the community is bothering you, that problem is between you and them.
Email on file
If there is ever an abuse issue or
we need to contact you, the email address on file will be used
for this purpose. It is your responsibility to ensure the email address
on file is current or up to date at all times.
Failure to respond to email from our abuse department within 48 hours may result in the suspension or termination of your services.
Content
All services provided by the Hideaway may only be used for lawful purposes. The laws of the State of
Florida, the State of Texas, and the United States of America apply.
The member agrees to indemnify and hold harmless the Hideaway from any claims resulting from the use of our services.
It is prohibited to post any image or wording that, in our judgment, is obscene or threatening or depicts or is related to extreme violence, snuff, scat or the elimination of any bodily waste on another person, bestiality, zoophilia, mutilation, rape, incest or minors in sexual situations either overtly or in innuendo anywhere on the site, including the URL and meta tags.
Potential harm to minors is strictly forbidden, including but not limited
to child pornography or content perceived to be child pornography (Lolita).
Any membership found to host child pornography or linking to child pornography
will be suspended immediately without notice. Violations will be reported to the appropriate law enforcement agency.
If in doubt regarding the acceptability of
your site or service, please contact us at [abuse at nethideaway dot com] and we
will be happy to assist you. All abuse issues
must be dealt with via trouble ticket/email and will have a response
within 48 hours.
The Hideaway reserves the right to change the membership fees and any other charges at anytime.
The Hideaway reserves the right to, at our sole discretion, make any changes, modifications, amendments, alterations, and or deletions in any feature or group of features in the services we make available, at any time.
Backups and Data Loss
Your use of The Hideaway's services is at your sole risk. The Hideaway is not responsible
for files and/or data residing in your member area. You agree to take full
responsibility for files and data transferred and to maintain all
appropriate backup of files and data stored in your member area(s) on the Hideaway website.
Cancellations
The Hideaway reserves the right to cancel your account at any time with or
without notice.
Disclaimer
The Hideaway makes no warranties of any kind, expressed or implied for services
we provide.
Disclosure to law enforcement
The Hideaway reserves the right at all times to monitor, review, retain, and/or disclose any information as necessary to satisfy any applicable law, regulation, or legal process, without consent or notification to the subscriber upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.
Bottom Line
Just so we're clear, if you don't agree to any part of these terms you have our blessing to hit the high road.
